We cannot and do not warrant or guarantee the accuracy of any information, including pricing, product images, specifications, availabilities, and services. We guarantee a Service Level Agreement (SLA) of 99.5% monthly availability for the Service. This means there might be an unplanned downtime of up to 3.6 hours per month. However, it is our goal to keep the Service available at all times, except during scheduled or unscheduled maintenance periods or any unavailability caused by circumstances beyond our control, such as natural disasters, governmental actions, or failures by third-party providers.
Scheduled maintenance, when necessary, will be notified at least 24 hours in advance. These maintenance periods will not count towards the 99.5% SLA calculation. During maintenance hours, whether scheduled or not, we will not offer compensations to users, even if they are paying users.
The Service and its original content (excluding User Contributed Content), features and functionality are and shall remain the exclusive property of Buddyble SAS and its licensees. The Service is protected by copyright, trademark and other laws of both Colombia and foreign countries. Our trademarks and distinctive signs may not be used in other products or services without first obtaining the express written authorization of Buddyble SAS.
We strongly recommend that you read the terms and conditions and privacy policies of any third-party service or website you visit.
We may decide to close or suspend your account immediately and for any reason (including, but not limited to, for violation of these Terms), without notice and without liability of any kind.
Following closure, your right to access the Service will immediately terminate.
If you wish to close your account, you can do so from the "Delete my account" menu or you can simply stop using the Service.
Neither Buddyble SAS nor its officers, employees, partners, agents, distributors or affiliates shall be liable under any circumstances for any indirect, incidental, special, incidental or punitive damages, including but not limited to loss of benefits, information, utility, goodwill and other intangible losses incurred by reason of (i) your access to, use of, or inability to access or use the Service; (ii) any behavior or content contributed by a third party to the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or modification of your broadcasts or content, even if supported by a warranty, contract, tort (including negligence) or any other legal theory, and regardless of whether or not you have been informed of the possibility of such damages occurring, even if the remedies provided herein beforehand are shown to have failed of their primary purpose.
Your use of the Service is at your own risk. The Service is provided as is/as available, and without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance performance.
Buddyble SAS, its subsidiaries, affiliates and licensors do not warrant that a) the Service will function uninterruptedly and securely, or that it will be available at any time and from any location; b) that its errors or defects will be corrected; c) that the Service is free of viruses or other harmful components; or that d) the results of using the Service will meet your expectations.
These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms will survive. These Terms constitute the entire agreement in relation to the Service we offer, and therefore supersede any previous agreements in relation to the Service.
We reserve the right to modify or replace these Terms at any time and at our sole discretion. If there is a material revision, we will make a reasonable effort to notify you at least 30 days in advance of the effective date of the new terms. We will determine what constitutes a material change at our discretion.
By continuing to access or use our Service after those changes take effect, you are agreeing to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
